Omnibus bill and the outlook of Indonesian democracy

The Indonesian civil society has raised their voices against the so-called Omnibus law, a packaged law for deregulation since September last year, waging a series of on-and-offline campaign(#TolakOmnibusLaw). Upon seeing the law passed, angry citizens responded fiercely, for example, setting a fire on a Transjakarta(public bus operator) bus stop. The editorial of Tempo read that people's political participation has been shrunken over the six-year rule by the Jokowi government, which succeeded in re-election in September 2019, and warned, “It is be too early to establish a Jokowi kingdom.” Despite the strong opposition from the civil society and media, the bill was signed by the President on November 2 into Law No.11 of 2020 on Job Creation.
The Omnibus bill on job creation was initiated by the Jokowi government for deregulation and proposed to the House of Representatives on February 12, 2020, covering 79 acts including media acts, labor acts, and environment acts made subject to packaged revision. The objective of the bill was said to be job creation on the ground of the trickle-down theory that deregulation and simplified business licensing processes would boost internal and external investment and businesses, leading to more jobs and economic improvement.
The Omnibus bill was designed to “improve protection and the ease of doing business for micro, small and middle-sized business entities, enhance investment ecosystem, accelerate central and national strategic projects, and enhance protection and welfare of workers. To this end, range of laws that were related to the aforementioned and were not effective in creating jobs should be amended. In doing so, the amendment process should be initiated in the form omnibus law to effectively address a number of legal issues and matters effectively”.
The investment, land acquisition, ease of doing business, central government investment and strategic national projects have to do with 148 articles, while employment and job creation have to do with only 12 articles, indicating that Omnibus law mostly focused on investment and business deregulation. For this reason, it is proposed that the 3rd consultative comitte should change the title of the bill to law on improvement of business ease from law on job creation.
The Omnibus law would affect democracy in Indonesia in three ways. First the trust, the prime value of democracy, among the President, the parliament and the citizens, is broken into pieces. The president and the parliament made a law that would affect the overall aspects of citizen's lif including labor, environment, and resources despite the fierce protest of the civil society. Second, it weakened the decentralization system and local autonomy. With the Omnibus law endorsed and approved, the administrative power, the level of fiscal independence, and the authority over environment protection and resource distribution at respective municipalities have been greatly diminished. Third, the Soeharto-style collusion between business and politicians around the energy and mining sectors officially revived. This is an outright reversal of the civil society's call for system reform for transparent and democratic control of political powers and natural resoures made after Soeharto stepped down in 1998.
Indonesian political researcher Made Supriatma, a visiting fellow of ISEA-Yusof Ishak Insitute, mentioned that the Omnibus law is a litmus test for Indonesian democracy in his contribution on November 4 to Mojok, an online media. He also pointed out that the 2nd New Order Generation, the children whose parents served the New Order government led by Soeharto, have designed this law as politicians and businessmen.
Paradoxically Jokowi was welcomed enormously by the citizens when he was elected the President in 2014 and people shouted goodbye to the New Order. They looked forward to the future to be led by Jokowi, who had served as an elected official known for hard-working with a humble family background. The Indonesian civil society expected that the new government would be able to get rid of corruption, collusion, and nepotism (Korupsi, Kolusi, Nepotisme), the legacy of the New Order era, and uproot the long-stood business and politics collusion.
As if defying all those expectations, Jokowi, who succeeded in re-election in 2019, began talking authoritative steps late last year. The sign of his U-turn to the New Order was detected when he had chosen the members of his coalition government not from the experienced expert pool but from the political parties. The obvious signal came with the amendment of KPK law (Corruption Eradication Commission Law) last year. The law, enforced in 2002, is to protect the independence of the Corruption Eradication Commission, which had been the target of desperate attacks by the people close to Soeharto. The Commission had investigated into corruption charges of high-level officials including the minister of sport and the chief of police, criminalizing them. Being recognized for this feat, the Commission has been well received as the most successful organization as a democract watchdog in Indonesia.
The economic analysts and scholars had already warned of his business friendliness even when he was a presidential candidate. They said that Jokowi crew popular with his people friendly image, but he was a market-friendly leader who knew the importance of welfare and had a business and investment-centric mind when it came to economic policy. Eve Walburton, an Australian researcher, wrote in her paper title “Jokowi and the New Developmentalism”(2016) that Jokowi secured his political ground built upon the overwhelming popularity during the early stage of his presidency and then weaved the political landscape anew to execute his economic development agenda.
Robertus Robet, a visiting scholar(sociology) at the University of Melbourne asserted that the Jokowi government sacrificed democracy for economic growth. Minister of Finance Sri Mulyani(2014-current) said, “In the past, when the government was heavily authoritarian, investment came. Once we became democratic, our ability to create a good investment climate lessened. The voices of concern about regress of the Indonesian democracy and the authoritarian tendency of the Jokowi government culminate in the Omnibus law from the media and the academia.
Putting behind the solid elites, military politics, and patronage democracy, Jokowi in his early presidency has chosen a political alliance to minimize resistance from the entrenched power instead of liquidation of the past, environment and development justice, and closing wealth gap, which had been requested by the civil society. The Jokowi government has been running against democratic developments in the process of intimidation, deliberation, passage, and final endorsement of the Omnibus Law. Of late, even the military and the police intelligence team supervise and punish the civil movement against the Omnibus law and the government. It is also noteworthy that the intelligence apparatuses have their budget swelling since the beginning of this government. The road ahead of the Indonesian civil society looks bumpier than ever.

옴니버스 법과 인도네시아 민주주의 전망
"아시아 민주주의 위기대응을 위한 시민사회연대"

“이제 탓해야 할 것은 과두정치만이 아니다. 조코위 역시 인도네시아 민주주의의 쇠퇴에 대한 책임을 져야 한다.”
인도네시아 최대 시사주간 <뗌뽀>(Tempo)의 10월 마지막주 발행호 논설 '조코위의 재임 저주'는 이런 문장으로 끝난다. 조코 위도도 대통령(이하 조코위)이 10월 5일 인민대표대회(DPR) 본의회를 통과한 ‘일자리 창출 법’(Undang-Undang Cipta Kerja)을 검토하고 법으로 발효하는 최종 서명을 앞둔 시점이었다.
인도네시아 시민사회는 이미 지난해 9월부터 일명 ‘옴니버스 법안’이라고 불리는 규제 완화 패키지 법안에 반대하며 온라인과 오프라인에서 ‘옴니버스 입법 반대’(#TolakOmnibusLaw) 운동을 벌여 왔다. 법안이 의회를 통과하자 성난 시민들이 자카르타 공공버스인 ‘트랜스자카르타’ 정류소에 불을 지르는 등 격렬하게 반응했다. <뗌뽀>의 논설은 2019년 9월 재임에 성공한 조코위 정부의 6년에 대해 '국민의 정치 참여 범위가 축소됐다'고 지적하고, '조코위가 (정치)왕조를 세우기는 너무 이르다'고 경고했다. 이처럼 시민사회와 언론의 강한 반대에도 불구하고 법안은 11월 2일 조코위 대통령의 승인을 거쳐 ‘일자리 창출에 관한 법(UU No.11/2020)이 됐다.
동남아시아 민주주의 챔피언으로 꼽히던 인도네시아에 무슨 일이 벌어지고 있는 것일까?
’옴니버스 법’ 혹은 ‘일자리 창출법’은 조코 위도도 행정부가 2020년 2월 12일 인도네시아 의회에 발의한 규제 완화 패키지 법이다. 기존의 언론법, 노동법, 환경법 등 79개 법률을 일괄 개정한다는 내용을 담고 있다. 목적은 법안의 제목대로 ‘일자리 창출’인데, 규제를 완화하고 사업 허가 절차를 간소화하면 국내외 투자와 사업 활동이 활성화되어 많은 일자리가 만들어지고 경기가 진작될 것이라는 낙수효과에 대한 믿음을 바탕으로 설계된 법이다.
대통령 승인과 의회 통과 전 공개된 법안 서문에는 “소상공인과 중소기업 활동의 편의와 보호, 투자 생태계 향상, 국가전략사업 가속화, 노동자 보호와 복지 개선 등에 관련된 규정들을 바꾸는 노력의 일환으로 일자리 창출에 실효성이 없던 부문별 법을 개정하기 위해 하나의 법으로 몇몇 법률상의 다양한 문제점들을 종합적으로 해결할 수 있는 일괄 법(omnibus law) 방식으로 법적 돌파구를 마련할 필요가 있다.”고 발의 배경이 명시되어 있다.

옴니버스 법이 인도네시아 민주주의에 끼치는 영향은 크게 세 가지를 꼽을 수 있다. 먼저, 민주주의의 중요한 가치인 대통령, 의회, 시민 사이에서 의사결정 과정에 대한 신뢰 고리가 끊어졌다는 점이다. 대통령과 의회가 노동, 환경, 자원 등 시민의 삶 전반에 큰 영향을 주는 의사결정을 시민사회의 격렬한 반대를 외면한 채 법제화했다. 두 번째는 지방분권과 자치 제도의 약화다. 옴니버스 법이 승인되면서 군·시·주 단위의 기초 및 광역 자치 단체의 분권 행정력과 재정 자립, 환경 보호와 자원 배분 권한이 유명무실해졌다. 세 번째로 에너지·광물업계를 중심으로 한 과거 수하르또 군부 정권식 정경유착이 공식적으로 부활했다는 것이다. 이는 1998년 수하르토 퇴진 이후 정치적 권한과 자연 자원을 민주적이고 투명하게 통제할 수 있는 시스템 개혁을 요구한 시민사회의 요구와 반대로 향하는 흐름이다.
인도네시아 정치연구자 마데 수프리아트마(Made Supriatma, 싱가포르 동남아연구소 ISEAS-Yusof Ishak Institute 방문연구자)는 11월 4일 온라인 매체 ‘Mojok’에 기고한 글에서 옴니버스 법을 ‘인도네시아 민주주의가 마주한 시험대’라고 봤다. 그는 더 나아가 수하르토 신질서 시대 정권에 유착해 승승장구하던 엘리트 집권층의 자녀들 중 사업가와 정치인으로 성장한 ‘신질서 2세대’가 이 법을 설계했다고 지적한다.
‘신질서(Orde Baru)’란 쿠데타로 수카르노 초대 대통령을 몰아내고 1967년 집권한 수하르또가 제시한 국정표어인데, 인도네시아 시민사회에서는 민주주의와 인권이 탄압받던 수하르또 군부정권 전반을 회고하는 표현으로 자주 쓰인다. 가령, 인도네시아에서 ‘신질서’로 회귀한다는 표현은 ‘민주주의의 쇠퇴’를 우려할 때 등장한다. 이 표현은 옴니버스 법안이 처음 시민사회의 큰 우려로 부상한 이후 인도네시아 독립기자연맹(AJI) 등 언론과 인도네시아 정치 연구자들 사이에 자주 쓰인 바 있다.
역설적인 것은 시민들이 조코위가 처음 대통령으로 당선된 2014년 당시에 ‘신질서와의 작별’을 고하며 열광했다는 점이다. 평범한 시민 출신, 일을 열심히 하는 선출직 관료였던 조코위에 대한 시민들의 높은 기대를 반영하는 표현이었던 셈이다. 인도네시아 시민사회는 특히 신질서 시대의 잔재로 꼽히는 ‘부패, 결탁, 족벌주의’(Korupsi, Kolusi, Nepotisme)를 극복하고 오랜 정경유착의 뿌리를 뽑을 것을 기대했다.
그러나 2019년 재임에 성공한 조코위는 재임 초반인 지난해 말부터 권위주의적인 행보를 감행하고 있다. ‘신질서로위 회귀’ 조짐은 이미 초임 2기 내각 개편(2016)에서 경험있는 전문가 대신 연립정부를 구성한 정당 정치인을 선택할 때부터 드러났다. 보다 본격적인 신호탄은 지난해 있었던 공직자 부패감시기구인 부패척결위원회(KPK)법 개정이다. 2002년 발효된 이 법은 수하르토의 잔재들이 눈엣가시처럼 여기며 무력화를 시도해 온 부패척결위원회의 독립성을 보장하는 법이다. 부패척결위원회는 지금까지 스포츠부 장관, 경찰 총장 등 고위공직자의 부패 혐의를 조사하고 기소해 형사 처벌까지 이끌어냈다. 이런 이유로 현재까지 인도네시아에서 민주적 권력 감시 기능을 가장 성공적으로 수행한 기구로 평가받고 있다. 조코위 정부는 시민들의 연이은 반대 시위를 외면한 채 재임 직후인 지난해 9월 개정법을 발의하고 통과시켰고 바로 뒤이어 광산법 개정과 옴니버스 법 통과까지 밀어붙였다.
인도네시아 경제 정책 전문가와 경제학자들은 초선 후보 시절부터 조코위 정부의 ‘비즈니스 프렌들리’를 우려한 바 있다. ‘조코위가 친서민 이미지로 유명해졌지만 복지의 중요성을 아는 시장친화형 리더’이며, 경제 정책 기조에 있어서는 일반 대중보다 사업가와 투자자의 눈높에 맞춰져 있다는 것이다. 오스트레일리아 연구자 이브 왈버튼은 ‘조코외위 신개발주의’(2016)라는 제목의 논문에서 조코위가 임기 초반 폭발적인 대중 지지를 기반으로 정치적 안정을 확보한 후 경제 개발 의제를 실행하기 위해 정치지형을 새로 짰다고 지적했다.
로베르투스 로베트 멜번대학 방문교수(사회학)는 조코위 정부가 또다시 경제 성장을 위해 민주주의를 거부하고 있다고 지적한다. 스리 물리야니 재무부장관(2014-현재)은 언론에 “과거 권위주의 정부 시절 투자가 유입됐다. 민주 정부가 들어선 이후 좋은 투자 환경을 조성하는 능력이 하락했다‘고 말하기도 한다. 2018년 오스트레일리아 국립대학교(ANU) 박사과정 연구자의 논문 ‘조코위의 권위주의적 행보와 인도네시아 민주주의 위축’이 인도네시아 시민사회와 동남아시아 정치와 민주주의 연구자들 사이에서 큰 주목을 받은 바 있다. 인도네시아 민주주의 쇠퇴와 조코위 정부의 정치적 권위주의를 우려하는 인도네시아 언론과 학계의 목소리는 옴니버스 법을 둘러싸고 최절정에 달한 상황이다.
인도네시아가 경험하고 있는 민주주의 위기는 리더가 강력한 개발 정권을 확립하기 위해 개혁 대신 현실정치와 타협한 결과로 보인다. 놀라운 점은 조코위가 시민사회의 열광적인 지지를 등에 업고 유력 정치 가문, 군부, 기성 정당 출신의 견고한 엘리트 정치 지형을 돌파하고 집권했는데 정작 임기 안정기에 들자마자 시민을 배신하고 기존의 현실정치를 더욱 강화했다는 점이다.
조코위는 이미 초임기 중반에 견고한 전통 엘리트, 군부 정치와 후원 민주주의 지형에서 시민사회가 요구하는 과거사 청산, 환경과 개발 정의 확립, 빈부 격차 해소 대신 집권층의 저항을 최소화하는 정치 동맹을 택했다. 재임기 초반에 옴니버스 법이 발의, 심의, 통과, 최종 승인되는 과정에서 조코위 정부는 민주적 발전과 정면으로 역행하고 있다. 최근에는 군과 경찰 정보부까지 옴니버스 법에 반대하고 조코위 정부를 비난하는 시민들의 움직임을 온·오프라인으로 감시하고 처벌하고 있다. 조코위 정부 들어 예산이 급격하게 증가한 곳이 정보부라는 점도 주지할 만하다. 인도네시아 시민사회 앞에 놓인 길이 점점 더 험난해질 것으로 보인다.

옴니버스 법이 인도네시아 민주주의에 끼치는 영향은 크게 세 가지를 꼽을 수 있다. 먼저, 민주주의의 중요한 가치인 대통령, 의회, 시민 사이에서 의사결정 과정에 대한 신뢰 고리가 끊어졌다는 점이다. 대통령과 의회가 노동, 환경, 자원 등 시민의 삶 전반에 큰 영향을 주는 의사결정을 시민사회의 격렬한 반대를 외면한 채 법제화했다. 두 번째는 지방분권과 자치 제도의 약화다. 옴니버스 법이 승인되면서 군·시·주 단위의 기초 및 광역 자치 단체의 분권 행정력과 재정 자립, 환경 보호와 자원 배분 권한이 유명무실해졌다. 세 번째로 에너지·광물업계를 중심으로 한 과거 수하르또 군부 정권식 정경유착이 공식적으로 부활했다는 것이다. 이는 1998년 수하르토 퇴진 이후 정치적 권한과 자연 자원을 민주적이고 투명하게 통제할 수 있는 시스템 개혁을 요구한 시민사회의 요구와 반대로 향하는 흐름이다.
인도네시아 정치연구자 마데 수프리아트마(Made Supriatma, 싱가포르 동남아연구소 ISEAS-Yusof Ishak Institute 방문연구자)는 11월 4일 온라인 매체 ‘Mojok’에 기고한 글에서 옴니버스 법을 ‘인도네시아 민주주의가 마주한 시험대’라고 봤다. 그는 더 나아가 수하르토 신질서 시대 정권에 유착해 승승장구하던 엘리트 집권층의 자녀들 중 사업가와 정치인으로 성장한 ‘신질서 2세대’가 이 법을 설계했다고 지적한다.
‘신질서(Orde Baru)’란 쿠데타로 수카르노 초대 대통령을 몰아내고 1967년 집권한 수하르또가 제시한 국정표어인데, 인도네시아 시민사회에서는 민주주의와 인권이 탄압받던 수하르또 군부정권 전반을 회고하는 표현으로 자주 쓰인다. 가령, 인도네시아에서 ‘신질서’로 회귀한다는 표현은 ‘민주주의의 쇠퇴’를 우려할 때 등장한다. 이 표현은 옴니버스 법안이 처음 시민사회의 큰 우려로 부상한 이후 인도네시아 독립기자연맹(AJI) 등 언론과 인도네시아 정치 연구자들 사이에 자주 쓰인 바 있다.
역설적인 것은 시민들이 조코위가 처음 대통령으로 당선된 2014년 당시에 ‘신질서와의 작별’을 고하며 열광했다는 점이다. 평범한 시민 출신, 일을 열심히 하는 선출직 관료였던 조코위에 대한 시민들의 높은 기대를 반영하는 표현이었던 셈이다. 인도네시아 시민사회는 특히 신질서 시대의 잔재로 꼽히는 ‘부패, 결탁, 족벌주의’(Korupsi, Kolusi, Nepotisme)를 극복하고 오랜 정경유착의 뿌리를 뽑을 것을 기대했다.
그러나 2019년 재임에 성공한 조코위는 재임 초반인 지난해 말부터 권위주의적인 행보를 감행하고 있다. ‘신질서로위 회귀’ 조짐은 이미 초임 2기 내각 개편(2016)에서 경험있는 전문가 대신 연립정부를 구성한 정당 정치인을 선택할 때부터 드러났다. 보다 본격적인 신호탄은 지난해 있었던 공직자 부패감시기구인 부패척결위원회(KPK)법 개정이다. 2002년 발효된 이 법은 수하르토의 잔재들이 눈엣가시처럼 여기며 무력화를 시도해 온 부패척결위원회의 독립성을 보장하는 법이다. 부패척결위원회는 지금까지 스포츠부 장관, 경찰 총장 등 고위공직자의 부패 혐의를 조사하고 기소해 형사 처벌까지 이끌어냈다. 이런 이유로 현재까지 인도네시아에서 민주적 권력 감시 기능을 가장 성공적으로 수행한 기구로 평가받고 있다. 조코위 정부는 시민들의 연이은 반대 시위를 외면한 채 재임 직후인 지난해 9월 개정법을 발의하고 통과시켰고 바로 뒤이어 광산법 개정과 옴니버스 법 통과까지 밀어붙였다.
인도네시아 경제 정책 전문가와 경제학자들은 초선 후보 시절부터 조코위 정부의 ‘비즈니스 프렌들리’를 우려한 바 있다. ‘조코위가 친서민 이미지로 유명해졌지만 복지의 중요성을 아는 시장친화형 리더’이며, 경제 정책 기조에 있어서는 일반 대중보다 사업가와 투자자의 눈높에 맞춰져 있다는 것이다. 오스트레일리아 연구자 이브 왈버튼은 ‘조코외위 신개발주의’(2016)라는 제목의 논문에서 조코위가 임기 초반 폭발적인 대중 지지를 기반으로 정치적 안정을 확보한 후 경제 개발 의제를 실행하기 위해 정치지형을 새로 짰다고 지적했다.
로베르투스 로베트 멜번대학 방문교수(사회학)는 조코위 정부가 또다시 경제 성장을 위해 민주주의를 거부하고 있다고 지적한다. 스리 물리야니 재무부장관(2014-현재)은 언론에 “과거 권위주의 정부 시절 투자가 유입됐다. 민주 정부가 들어선 이후 좋은 투자 환경을 조성하는 능력이 하락했다‘고 말하기도 한다. 2018년 오스트레일리아 국립대학교(ANU) 박사과정 연구자의 논문 ‘조코위의 권위주의적 행보와 인도네시아 민주주의 위축’이 인도네시아 시민사회와 동남아시아 정치와 민주주의 연구자들 사이에서 큰 주목을 받은 바 있다. 인도네시아 민주주의 쇠퇴와 조코위 정부의 정치적 권위주의를 우려하는 인도네시아 언론과 학계의 목소리는 옴니버스 법을 둘러싸고 최절정에 달한 상황이다.
인도네시아가 경험하고 있는 민주주의 위기는 리더가 강력한 개발 정권을 확립하기 위해 개혁 대신 현실정치와 타협한 결과로 보인다. 놀라운 점은 조코위가 시민사회의 열광적인 지지를 등에 업고 유력 정치 가문, 군부, 기성 정당 출신의 견고한 엘리트 정치 지형을 돌파하고 집권했는데 정작 임기 안정기에 들자마자 시민을 배신하고 기존의 현실정치를 더욱 강화했다는 점이다.
조코위는 이미 초임기 중반에 견고한 전통 엘리트, 군부 정치와 후원 민주주의 지형에서 시민사회가 요구하는 과거사 청산, 환경과 개발 정의 확립, 빈부 격차 해소 대신 집권층의 저항을 최소화하는 정치 동맹을 택했다. 재임기 초반에 옴니버스 법이 발의, 심의, 통과, 최종 승인되는 과정에서 조코위 정부는 민주적 발전과 정면으로 역행하고 있다. 최근에는 군과 경찰 정보부까지 옴니버스 법에 반대하고 조코위 정부를 비난하는 시민들의 움직임을 온·오프라인으로 감시하고 처벌하고 있다. 조코위 정부 들어 예산이 급격하게 증가한 곳이 정보부라는 점도 주지할 만하다. 인도네시아 시민사회 앞에 놓인 길이 점점 더 험난해질 것으로 보인다.
